Terms & Conditions

Please read these terms carefully. They govern your use of Sirocco's concierge and advisory services.

These Terms & Conditions apply to all users of Sirocco's concierge, coordination, and advisory services. By engaging our services, you confirm that you have read and accept these terms. For any questions, contact us at [email protected].

1. Definitions

In these Terms & Conditions, the following definitions apply:

  • "Agreement" — these Terms & Conditions, along with any service engagement, quotation, or written correspondence forming part of the arrangement between you and Sirocco.
  • "Service" — the concierge, viewing coordination, resident care, tenancy support, and related advisory functions provided by Sirocco, as described on our website and in individual service descriptions.
  • "We / Us / Our" — Sirocco, operating from 205 Kamala Beach Road, Kamala, Kathu, Phuket 83150, Thailand.
  • "You / User / Client" — any individual or entity that accesses our website, enquires about, or engages our Services.
  • "Content" — all text, images, documents, shortlists, notes, and other materials provided by Sirocco in the course of delivering our Services.
  • "Third-Party Professionals" — independent licensed practitioners (legal, financial, or technical) to whom Sirocco may make introductions at your request; these parties act independently and are not agents of Sirocco.

2. Acceptance of Terms

By submitting an enquiry form, engaging a service, or making a payment to Sirocco, you confirm that:

  • You are at least 18 years of age.
  • You have the legal capacity and authority to enter into this Agreement.
  • You have read, understood, and agree to be bound by these Terms.
  • You will use our Services only for lawful purposes consistent with these Terms.

If you are acting on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Service Description

Sirocco provides concierge and coordination services for clients seeking luxury residential accommodation in Thailand. Our current service offerings are:

Private Viewing Coordination (฿5,400)

A curated shortlist of luxury apartments and penthouses across Sukhumvit, Sathorn, Silom, Phuket, and Pattaya, with candid property notes and viewing logistics handled on your behalf. This is an information and coordination service; it does not constitute estate agency, brokerage, or licensed real property advisory.

Resident Care Programme (฿16,700)

End-to-end arrival support including transfer, cleaning, household setup, and access to a dedicated personal manager for day-to-day requests during your stay or settling-in period.

Long-Stay Support & Renewal Assistance (฿32,900)

Tenancy coordination from offer through signing and renewal, background research on ownership and listing, plain-language walkthrough of agreement terms, and introductions to independent legal professionals for formal review. Sirocco coordinates; it does not provide legal advice or act as a licensed legal representative.

Service availability may vary by location and season. Sirocco reserves the right to adjust the scope of services where external circumstances — including property availability, access, or third-party conduct — affect delivery.

4. User Responsibilities

As a client of Sirocco, you agree to:

  • Provide accurate, complete, and up-to-date information when requested, including your identity, contact details, and property preferences.
  • Respond to communications from Sirocco in a timely manner to allow service delivery to proceed.
  • Use any shortlists, property notes, or concierge materials provided by Sirocco solely for your own personal residential decision-making.
  • Not reproduce, share, sell, or commercially exploit any Content provided by Sirocco without prior written consent.
  • Treat Sirocco staff, partners, and any third-party professionals introduced through our service with courtesy and respect.
  • Not engage Sirocco's services for any unlawful purpose, including but not limited to money laundering, fraudulent transactions, or misrepresentation to landlords or property owners.
  • Understand that Sirocco operates as a coordination and concierge service and does not hold, manage, or provide legal authority over any property.

5. Intellectual Property

All content, materials, and intellectual property on the Sirocco website and within delivered service outputs — including shortlists, property notes, itineraries, templates, and written guidance — remain the property of Sirocco or our licensed suppliers.

We grant you a limited, non-exclusive, non-transferable licence to use the Content we provide solely for your own personal residential decision-making. You may not:

  • Reproduce or distribute Sirocco's materials for commercial gain.
  • Modify, adapt, or create derivative works from our Content.
  • Present Sirocco's research, notes, or compiled shortlists as your own original work.

Any feedback, suggestions, or ideas you provide to Sirocco may be used by us freely and without compensation to you.

6. Fees & Payment

  • 6.1 Pricing. Service fees are quoted in Thai Baht (฿) as stated on our website and confirmed in writing prior to engagement. Fees do not include VAT unless explicitly stated.
  • 6.2 Payment. Payment terms are confirmed at the point of engagement. Sirocco accepts bank transfer and other methods as indicated at the time of booking.
  • 6.3 Refund Policy. If Sirocco is unable to deliver the agreed service for reasons within our control, we will discuss a fair resolution with you, which may include a partial or full refund depending on work completed. Refunds are not available where services have been substantially delivered or where non-delivery results from factors outside Sirocco's reasonable control (including property unavailability, landlord decisions, or third-party delays).
  • 6.4 Changes. Fees for additional scope beyond the original engagement will be communicated and agreed in writing before work proceeds.

7. Service-Specific Terms

  • 7.1 Viewing Coordination. Sirocco coordinates access to properties on an availability basis. We do not control landlords' scheduling, property condition, or availability. A curated shortlist represents our reasonable assessment at the time of preparation; properties may be withdrawn or changed without notice by third parties.
  • 7.2 Resident Care. The Resident Care Programme covers the scope described in the service specification. Requests falling outside the agreed scope will be addressed on a reasonable-efforts basis and may be subject to additional fees.
  • 7.3 Long-Stay Support & Renewal Assistance. This service involves coordination and plain-language explanation of tenancy terms only. It does not constitute legal advice. All formal legal questions regarding lease agreements, ownership structures, or contract enforceability should be directed to independent licensed legal professionals, whom Sirocco can introduce upon request. You are responsible for seeking and acting on appropriate professional advice.
  • 7.4 Third-Party Introductions. Where Sirocco introduces you to independent legal, financial, or technical professionals, those parties operate independently and are solely responsible for the advice and services they provide. Sirocco accepts no liability for the conduct, advice, or outputs of third parties.

8. Disclaimers

  • 8.1 No Legal or Financial Advice. Nothing Sirocco provides constitutes legal, financial, tax, or investment advice. All materials are for informational and coordination purposes only.
  • 8.2 Property Information. Property details, descriptions, and notes in our shortlists are compiled in good faith from publicly available and partner-sourced information. Sirocco does not warrant the accuracy, completeness, or currency of third-party property data.
  • 8.3 Service Provided "As Is". Our services are delivered with reasonable professional care. However, Sirocco does not warrant that every outcome will meet your specific expectations, as residential searches and tenancy processes involve inherent uncertainty and third-party decisions beyond our control.
  • 8.4 Website. This website is provided for information purposes. Sirocco endeavours to keep content accurate and current but does not warrant that the website will be uninterrupted, error-free, or free of harmful content.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Sirocco's total liability to you in connection with any engagement shall not exceed the total fees paid by you for the specific service giving rise to the claim.
  • Sirocco shall not be liable for indirect, consequential, incidental, or special damages, including loss of profits, loss of opportunity, or damage arising from third-party conduct (landlords, legal professionals, utility providers, or others).
  • Nothing in these Terms limits liability for fraud, personal injury caused by negligence, or any matter that cannot lawfully be excluded.
  • Sirocco is not liable for delays or failure to deliver caused by circumstances outside our reasonable control, including but not limited to natural events, government restrictions, or property market conditions.

10. Indemnification

You agree to indemnify and hold harmless Sirocco, its principals, staff, and associated parties from and against any claims, losses, damages, or costs (including reasonable legal fees) arising from: (a) your breach of these Terms; (b) your misuse of our services or materials; (c) your dealings with landlords, property owners, or third parties facilitated through our service; or (d) any inaccurate information you provided to Sirocco.

11. Termination

  • 11.1 By You. You may cancel or discontinue an engagement at any time by written notice. Fees for work already performed will be retained by Sirocco.
  • 11.2 By Sirocco. We may suspend or terminate services if you breach these Terms, behave in a manner that is threatening or abusive toward our team or partners, or if delivering the service would require us to act unlawfully or against professional standards.
  • 11.3 Survival. Clauses relating to intellectual property, liability, indemnification, and dispute resolution survive termination of any engagement.

12. Dispute Resolution

  • 12.1 Governing Law. These Terms are governed by the laws of Thailand.
  • 12.2 Jurisdiction. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Phuket Province, Thailand.
  • 12.3 Informal Resolution. Before initiating formal proceedings, we encourage you to contact us at [email protected] to seek an informal resolution. We will endeavour to respond within 10 working days.
  • 12.4 Mediation. If informal resolution is unsuccessful, either party may propose mediation through a mutually agreed mediator before commencing court proceedings.

13. General Provisions

  • 13.1 Entire Agreement. These Terms, together with any written service engagement, constitute the entire agreement between you and Sirocco regarding our services and supersede any prior representations or understandings.
  • 13.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
  • 13.3 Waiver. Sirocco's failure to enforce any right under these Terms does not constitute a waiver of that right.
  • 13.4 Assignment. You may not transfer your rights or obligations under these Terms without our prior written consent. Sirocco may assign its rights in connection with a business transfer or restructuring.
  • 13.5 Notices. Formal notices should be sent by email to [email protected] or by post to our registered address.

14. Changes to These Terms

Sirocco may update these Terms from time to time. We will post the revised version on this page with an updated "Last Updated" date. For material changes, we may notify active clients by email where practicable. Continued use of our services after the revised Terms are posted constitutes acceptance of those changes. We encourage you to review this page periodically.
